- ‘Terms and Conditions’, the general terms and conditions of I Love Walking, ILW for short;
- ‘Event’, a private or public event at which - for example, but not exclusively - an activity of a tourist nature takes place, including - but not limited to - an excursion, a museum visit, a concert or a sporting event;
- ‘Location’, the place where the event takes place;
- ‘Organiser’, the party responsible for the production and/or organisation of the event;
- ‘Agreement’, the agreement between I Love Walking and the consumer for the sale and delivery of the tickets;
- ‘Tickets’, proof of admission to an event;
2. Applicability
2.1 The terms and conditions below and the conditions for booking and ordering at I Love Walking apply to all offers, orders and agreements of I Love Walking.
2.2 In addition, the terms and conditions of the organiser and the terms and conditions of the party responsible for the locations also apply to the agreement. If, during the event, there is a conflict between the clauses in these terms and conditions and the aforementioned terms and conditions, the clauses in these terms and conditions will prevail. Copies of the terms and conditions of the party responsible for the Location or of the organiser are available on request from the person responsible for the location concerned or from the organiser.
2.3 When buying or ordering a product, the consumer must agree that the terms and conditions may be applied.
2.4 Deviations from the clauses in the Terms and Conditions are only available in writing, in which case the other clauses remain in force.
2.5 All rights and claims stipulated for I Love Walking in these terms and conditions and further agreements also apply to intermediaries and other third parties engaged by I Love Praag Tours.
3. Prices/offers
3.1 All offers made by I Love Walking are without obligation, and I Love Walking has the right to change its prices, in particular if necessary because of public law or other regulations.
3.2 All prices are stated in euros, including VAT.
3.3 In some cases promotional prices apply. These prices apply during a specific period while stocks last. The prices cannot be invoked for periods before or after this specific period.
3.4 I Love Walking cannot be held to prices that are clearly incorrect, for example as a result of typing or printing errors. No rights can be derived from incorrect price information.
3.5 For each ticket a fixed amount of service costs is charged, which varies depending on the event. The service costs include transaction costs, consultation costs and shipping costs.
4. Cancellations and returns
4.1 An organiser is entitled to cancel an event or change its date. If this happens, I Love Walking will come up with an acceptable solution. If an event is cancelled or postponed, I Love Walking will do its utmost to inform you of this change as soon as possible. However, I Love Walking cannot guarantee that it will be able to inform you in time if a tour is cancelled or takes place at a time other than agreed. Furthermore, I Love Walking is not responsible for refunds, compensation or for costs that you would like to recover, for example travel costs, accommodation costs and/or other related goods or services.
4.2 Before you confirm your booking, you must always check that you have ordered the correct number of tickets. Tickets for a product with a specific date or time (timeslot tickets) cannot be exchanged. Open tickets (tickets without a specific date and time) ordered in the wrong quantity can be exchanged within fourteen days of purchase if they were bought online. If you want your money back after ordering an open ticket, you must send an e-mail to mail@i-love-walking.com.
4.3 I Love Walking is not liable for damage to, misuse or loss of tickets. No duplicate tickets will be issued to replace tickets that have been misused, damaged, lost or stolen, and such tickets will not be refunded.
4.4 I Love Walking is not liable for delay, non-delivery or incorrect delivery of tickets; if you experience delay, non-delivery or incorrect delivery of your tickets, this cannot be attributed to I Love Walking.
4.5 Not using one or more tickets purchased in advance is at your own expense and risk; this also applies if the admission ticket is only valid for a certain time and/or date.
4.6 Our open tickets are valid for 1 year (12 months) from the date of purchase.
4.7 When rebooking an excursion, attraction, boat tour or museum, the traveller may be charged a fee for handling.
5. Payments
I Love Walking accepts various payment methods. Payments in euros and other currencies must be made via WERO, by credit card or by another method offered by our payment service provider Stripe. On request, cash payment at the start of the activity is also possible in certain cases. You will only receive a final confirmation of your booking once you have paid.
6. Delivery
6.1 Depending on the shipping method, the tickets will be delivered to the relevant address available in the I Love Walking address database.
6.2 The delivery times stated by I Love Walking are for indicative purposes only. Failure to meet the delivery period does not give rise to compensation, nor to the right to cancel your order or dissolve the agreement, unless failure to meet the delivery period is so serious that it cannot reasonably be required of you to adhere to the agreement. In that case you have the right to cancel your order or dissolve the agreement to the extent necessary.
7. Retention of title
7.1 Ownership of the delivered tickets is only transferred to you once you have fulfilled all your obligations to I Love Walking under any agreement. The risk with regard to the tickets passes to you at the moment of delivery.
8. Complaints and liability
8.1 You are obliged to check on delivery whether the tickets comply with the agreement. If this is not the case, you must inform I Love Walking in writing as soon as possible, or within (3) days of delivery, stating the reasons that make clear this is the case.
8.2 If it has been indicated that the tickets do not comply with the agreement, I Love Walking may choose to replace the tickets concerned with new tickets or to refund the amount paid.
8.3 Unresolved consumer complaints about digitally purchased products on the websites of I Love Walking can be resolved through the Online Dispute Resolution platform.
9. Electronic communication and evidence
9.1 I Love Walking is not responsible for misunderstandings, delays, distortions or incorrect transmission of data and messages resulting from the use of the internet or other means of communication between the customer and I Love Walking (or the parties engaged by the customer).
9.2 The records of I Love Walking serve as proof of the existence, content and performance of the agreement with the customer in legal proceedings, subject to proof to the contrary by the party who claims that the evidence is unreliable.
10. Force majeure
10.1 Without prejudice to other rights that may be claimed, in the event of force majeure I Love Walking has the right, at its own choice, to suspend the performance of your order or to dissolve the agreement without judicial intervention, by notifying you in writing, without I Love Walking being liable for damages, unless this would be unacceptable under the prevailing circumstances, taking reasonableness and fairness into account.
10.2 Force majeure means any failure that cannot be attributed to I Love Walking, because it is not attributable to it and cannot be regarded as its responsibility in accordance with the law, legal steps or generally accepted standards.
11. Special provisions, liability
11.1 The buyer of a ticket supplied by I Love Walking must behave as a well-mannered event visitor and comply with the instructions given to them by or on behalf of the organiser of the event to be visited, as well as by the competent authorities.
11.2 I Love Walking is not liable for any refusal by the organiser of an event or by government authorities to admit the buyer of a ticket supplied by I Love Walking to an event as a result of acts and/or omissions on the part of the buyer.
11.3 The buyer of a ticket attends the event at their own risk. I Love Walking is not liable for any damage the buyer suffers during the journey to or from the event or during the event.
11.4 The buyer of a ticket supplied by I Love Walking must inform themselves of the instructions issued by or on behalf of the organiser of the event or the authorities involved in connection with it, including any changes relating to the event, such as the start time, etc. I Love Walking is not obliged to provide the buyer of a ticket with further information on this.
12. Other provisions
12.1 If one or more of the provisions in these Terms and Conditions or any other agreement with I Love Walking conflicts with applicable statutory regulations, the provision concerned lapses and is replaced by a new legally applicable provision determined by I Love Walking.
12.2 Czech law applies to all agreements entered into with or concluded by I Love Walking. All disputes arising directly or indirectly from these agreements will be settled exclusively by the court of the capital city of Prague, Czech Republic.
